This Privacy Policy is in effect for the Site, any web page, third party social media site, e-mail list, onsite data collection, generic information and Personal Information (as defined below) collected and/or owned by us, including collection through the Site and any online features, products, services, promotions and/or programs we offer (collectively with the Site, the “Web Properties”).

The PWB Online Community is designed to facilitate communication among members for personal purposes. To safeguard the operation of the PWB Online Community, we have adopted this Privacy Policy. This Privacy Policy describes how we collect and use your information and under what circumstances we will disclose any such information. We suggest that you review this Privacy Policy periodically as we may update it from time to time.

What Information Do We Collect?

The Positively Wendy Bell, LLC and any third party we engage for the purpose of administering, operating, hosting, configuring, designing, maintaining and providing internal support for our Web Properties, may collect usage information, personal information, and other information you provide when you visit the Web Properties.

Usage Information: The types of usage information we collect may contain generic information about you when you visit the Web Properties, which may include, among other things, the following categories of information (collectively, “Usage Information”): (1) Internet Protocol (or IP) address, protocol and sequence information; (2) browsing history (including time spent at a domain, time and date of your visit) and number of clicks; and (3) aggregated information, including De-identified Data (as defined herein). We collect this information to help diagnose problems, administer our Web Properties and track usage statistics. All of this information is collected and used only in the aggregate; that is, it is entered into our database where we can use it to generate overall reports on our visitors, but not individual reports that identify you personally.

Personal Information:  The types of information we collect may include, among other things, the following categories of information (collectively, “Personal Information”): (i) contact information (e.g., name, address, phone number, email address, other biographical information); (ii) demographic information (e.g., date of birth, geographic area); (iii) payment information (e.g., bank account and credit/debit card numbers); and (iv) other information specific to you.

Other Information:  The types of information we collect may include, among other things, information related to your use of the Web Properties, such as interactions and communications between users of the Site and information that you choose to share with us or other members of the PWB Online Community  (collectively, “Other Information”).

Whether you submit any Personal Information to us is entirely up to you.  You are under no obligation to provide Personal Information.  However, this information is essential for the provision and quality of some of the services we offer to you, so we cannot provide you with certain services if you choose to withhold requested information.  

By using the Web Properties, you are consenting to have your Usage Information, Personal Information, and Other Information you provide transferred to and processed in the United States.

How is Information Collected?

We may collect Usage Information, Personal Information, and Other Information about you from the following sources:

  • information we receive from you, or on your behalf, through forms you complete, or if you contact us, for example to raise a query;
  • information we receive when you create an account on the Web Properties;
  • information we receive from your computer or mobile device;
  • information we receive from other sources, as permitted by applicable laws, rules and regulations; and
  • information we receive from you, even if we have not requested such information and the information is not information that we normally collect.

 How Do We Use Cookies and Other Tracking Mechanisms?

Cookies and Tracking: Most Internet sites collect data about visitors through the use of “cookies”. Cookies are small software programs that help sites recognize repeat visitors by assigning a random number to each desktop for tracking content preferences and traffic patterns. Cookies may be used to “connect” your computer to information stored in a separate location. The Web Properties may use browser cookies and other tracking mechanisms to track user behavior, alert you to new issues that we think might be of interest to you, record past activity at the Web Properties in order to provide you better service when you return to the Web Properties, or customize content based on your browser type or other information that you send us.

“Do Not Track” Signals: Note that your browser settings may allow you to automatically transmit a “Do Not Track” signal to websites and online services you visit.  Like many websites and online services, we currently do not alter our practices when we receives a “Do Not Track” signal from a visitor’s browser. 

How Do We Use Your Information?

We use the information we collect to improve our communications, improve our content and offerings, analyze usage, troubleshoot problems, resolve disputes, and enforce our Terms of Use.

We use the information we collect to generally improve the content and layout of the Web Properties, to notify you about updates to the Web Properties, and for our internal review. When you supply us with Personal Information in the course of creating an account, the information you provide will be added to our subscriber database. You will receive periodic news from us. If you do not want to receive such communications from us, please e-mail

We may send you e-mail with periodic news and information, or information on new services,  products or offerings. If you do not wish to receive such e-mails in the future, please contact us at to remove yourself from our e-mail list or update your email preferences in the email preferences section of the PWB Online Community. We reserve the right to send you notices about your account or communications regarding products or services you have purchased from us, even if you opt out of all voluntary e-mail notifications. We may also send you service-related announcements from time to time through the general operation of the service.

If you authorize us or our representatives to place telephone calls and/or send you text messages for PWB-related matters, our administrators may contact you at the number you provide. At any time, you may update your preferences by unchecking the permission box in the My Account Settings page within the PWB Online Community.

When May We Share Your Information with Third Parties?

Other PWB members can see content and comments that you choose to post to the Web Properties, as well as certain profile information you provide us. The other limited instances where we may share your personal information include:

  • We contract with third-party service providers in order to operate our business. Those service providers may need access to your information to perform fulfillment and other services. We undertake to provide only that portion of your information needed to perform the pertinent service, and we require that all of our service providers hold your information in confidence and use it only to provide the service for which they have been engaged.
    • When we have your consent. This includes sharing information with other services (like Facebook or Twitter) when you’ve chosen to link to your PWB Online Community account to those services or publish your activity on the Web Properties to them.  
    • We may share information with governmental agencies or other companies assisting us in fraud prevention or investigation or as required by applicable law. We may do so when: (1) permitted or required by law (for example, to respond to a lawful subpoena, warrant or court order); (2) trying to protect against or prevent actual or potential fraud or unauthorized transactions; (3) investigating fraud which has already taken place; or (4) we believe that disclosure is necessary to protect our rights or interests, or the rights or interests of others.
    • We reserve the right to transfer the information described in this Privacy Policy in connection with the a merger, sale or other disposition of all or part of our business and/or assets. We cannot make any representations regarding the use or transfer of your Personal Information or other information that we may have in the event of our bankruptcy, reorganization, insolvency, receivership, or an assignment for the benefit of creditors, and you expressly agree and consent to the use and/or transfer of your Personal Information or other information in connection with a sale or transfer of some or all of our assets in any of the above described proceedings.  Furthermore, we cannot and will not be responsible for any breach of security by any third parties or for any actions of any third parties that receive any of the information that is disclosed to us. 

We do not provide contact information to third party marketers without your permission. We share your information with third parties only in limited circumstances where we believe such sharing is (1) reasonably necessary to offer our services, (2) legally required or, (3) permitted by you. 

In addition to the other rights described in this Privacy Policy, at all times we shall have the right to exploit, share, and use for any purpose the information collected, including Personal Information, that is in an aggregated, anonymized form, such that you are not identified (collectively, “De-identified Data”).  For example, we have the right to share such information with peer companies and other third parties for research and other business development purposes.  Except as otherwise set forth herein, we may continue to use Personal Information and exploit, share and use your De-Identified Data after you deactivate or cancel your account with us. 

How Do You Know Your Information is Secure? 

We have appropriate security measures in place in our facilities to protect against the loss, misuse or alteration of information that we have collected from you so you can feel comfortable and secure. In addition, the Positively Wendy Bell Online Community is password-protected to allow access only to registered PWB members. Although these precautions should help to protect any personal information available through the Positively Wendy Bell Online Community from abuse or outside interference, a certain degree of privacy risk is faced any time information is shared over the Internet. We cannot guarantee the protection of information against interception, misappropriation, misuse, or alteration or that your information may not be disclosed or accessed by accidental circumstances or by the unauthorized acts of others. 

Positively Wendy Bell Online Community members have the ability to selectively hide the personal information that is listed in the online community to be viewed by other Positively Wendy Bell Online Community members. This is easily accomplished by clicking on the Privacy settings option found within your member profile page. 

The Privacy option on your My Profile page invites you to explore this page, review your record, and select any and all privacy settings you wish to apply. 








You are ultimately responsible for protecting your account information from disclosure to third parties, and you are not permitted to circumvent the use of required encryption technologies.  You agree to: (a) immediately notify us of any unauthorized use of your account, and/or any other breach of security; and (b) ensure that you log out from your account at the end of each session. While we may provide certain encryption technologies and use other reasonable precautions to protect your confidential information and provide suitable security, we do not and cannot guarantee or warrant that any information transmitted through the Internet is secure, or that such transmissions are free from delay, interruption, interception or error. 

Credit Card Information and Security

We do not store credit card information. Credit card transactions are transmitted to a secure financial gateway of our third party service providers.  We endeavor to protect the security of your payment information during transmission by using Secure Sockets Layer (SSL) technology. We take reasonable efforts to ensure that information collected through the Web Properties is not lost, misused or altered inappropriately by administering security measures.  However, unauthorized parties can potentially access all information accessible and/or transferred over the Internet; therefore, we cannot guarantee the security of your data transmitted to the Web Properties.

Children Under the Age of 18

We will not knowingly collect personally identifiable information from any person under the age of 18. Our services are not designed to attract the attention of persons under the age of 18. You affirm that you are more than 18 years of age, or an emancipated minor, or possess parental or legal guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy.  In any case, you affirm that you are over the age of 13, as THE WEB PROPERTIES ARE NOT INTENDED FOR CHILDREN UNDER 13 WHO ARE UNACCOMPANIED BY THEIR PARENT(S) OR LEGAL GUARDIAN(S).

Third Party Sites 

The Web Properties may now or in the future include links to websites not operated by The Positively Wendy Bell, LLC, including but not limited to commercial, educational, government, and sponsorship organizations (“Third Party Sites”). The Positively Wendy Bell, LLC is not responsible for and does not control the views expressed by, the content provided by, or the privacy practices exercised by any Third Party Site. We are also not responsible for the privacy practices of any Third Party Site. We encourage you review the individual privacy policies of any Third Party Site to learn more about how they collect and use personally identifiable information before submitting any personal information. Such Third Party Sites do not have access to any personal information or data you provide when registering or updating your account information pages within the Web Properties. This Privacy Policy applies solely to information collected by us or by one of our service providers on our behalf. 

European Union Users

If you are visiting us from the European Union, please note that we may collect, transfer, and continue to use your Personal Information outside the European Union for any of the purposes described in this Privacy Policy.  By using the Web Properties and providing us with your Personal Information, you consent to our collection, transfer, and continued use of your Personal Information in accordance with this Privacy Policy.

Your California Privacy Rights

Under California’s “Shine the Light” law, California residents who provide certain personally identifiable information in connection with obtaining products or services for personal, family, or household use are entitled to request and obtain from us (once a calendar year) information about the customer information we shared (if any) with other businesses for their own direct marketing uses.  If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2017 will receive information regarding 2016 sharing activities, if any). To obtain this information, please send an e-mail message to with “Request for California Privacy Information” in the subject line and in the body of your message.  We will provide the requested information to you at your e-mail address in response.  Please be aware that not all information sharing is covered by the “Shine the Light” requirements, and only information on covered sharing will be included in our response. 

Governing Law

This privacy policy is governed by the laws of the Commonwealth of Pennsylvania, without regard to its choice of law rule and without regard to the location of any user. Any dispute arising in connection with this policy must be resolved by arbitration as set forth in the Terms of Use governing the Web Properties. 

Changes To This Privacy Policy

From time to time, we may use the information you provide us for new, unanticipated uses not previously addressed in our Privacy Policy. If our information practices change at some time in the future we will post the policy changes on the privacy page of the Web Properties to notify you of these changes. We encourage you to check the Web Properties periodically for more information on what information we collect, how we use that information and under what circumstances we may disclose that information to others.  Your use of the Web Properties following such publication of any amendment of this Privacy Policy will signify your assent to and acceptance of its revised terms for all previously collected information and information collected from you in the future.  We will indicate near the bottom of this page the date this Privacy Policy was last revised.
